CalTrack — Terms of service

These Terms of Service ("Terms") govern your use of the CalTrack mobile application ("CalTrack", "the app", "the service"). Please read them carefully. By creating an account or using CalTrack you agree to these Terms.

1. Acceptance

By tapping "Sign up", "Continue with Apple", or "Continue with Google", or by otherwise using CalTrack, you agree to these Terms and to our Privacy policy. If you do not agree, do not use the app.

2. Eligibility

You must be at least 13 years old (16 in the EEA / UK) to use CalTrack. If you are under the age of majority in your country, you confirm that a parent or legal guardian has reviewed these Terms with you.

You must be legally able to enter into a binding contract in your jurisdiction.

4. Licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use CalTrack on devices you own or control, solely for your personal, non-commercial use, in accordance with these Terms and the rules of the app store you obtained CalTrack from (Apple App Store, Google Play, or TestFlight).

6. Your content (custom foods, recipes, submissions)

You retain ownership of the custom foods, recipes, and barcode-submission photos you create in CalTrack.

By submitting community content — currently barcode submissions (label, ingredient, or product photos) that other users may review — you grant us a worldwide, royalty-free licence to host, process, display to reviewers, and use that content for the operation of the verification flow. We will delete a community submission's photos as described in Privacy policy §6.

Private content (your food logs, weight logs, custom foods that you do not share, recipes that you do not share) is not licensed to us beyond what is necessary to operate the service for you.

You represent that you have the right to submit any content you upload.

7. Not medical advice

CalTrack is not a medical device and does not provide medical advice. The calorie targets, recommended daily allowances, upper-limit warnings, adaptive expenditure (TDEE), and nutrient calculations the app produces are informational estimates based on published reference data (e.g. NIH / IOM Dietary Reference Intakes, USDA FoodData Central) and on the inputs you provide. They are not a substitute for advice from a qualified physician, registered dietitian, or other licensed healthcare professional.

Do not use CalTrack to diagnose, treat, cure, or prevent any disease or condition. Always consult a qualified professional before making changes to your diet, supplementation, training, or treatment, especially if you are pregnant or nursing, under 18, over 65, have an eating disorder or a history of one, have diabetes, kidney disease, liver disease, cardiovascular disease, or any other medical condition, or are taking medication.

If you experience symptoms of an eating disorder, contact a healthcare professional immediately. CalTrack is not a treatment tool for eating disorders.

8. Fees and subscriptions

CalTrack is currently free to use. If we introduce paid features or subscriptions in the future, the pricing, billing terms, refund policy, and auto-renewal mechanics will be disclosed inside the app and on the relevant App Store / Google Play listing before you can subscribe, and a separate notice will be added to these Terms.

For any future paid subscription, billing is handled by Apple or Google. Cancellation and refunds follow the policies of the store you subscribed through.

9. Third-party services

CalTrack relies on third-party providers (Supabase, Fly.io, Sentry, Cloudflare, Apple, Google) listed in the Privacy policy §5, and on third-party nutrition data sources (USDA FoodData Central, Open Food Facts). Your use of those services through CalTrack is also subject to their respective terms. We are not responsible for the availability or content of third-party services.

Nutrition data sourced from USDA FoodData Central and Open Food Facts is provided as-is by those projects. We make a best effort to keep the catalog accurate, but we do not warrant that any individual nutrient figure is correct.

10. Intellectual property

The CalTrack name, logo, app design, source code, server code, and accompanying documentation are owned by the operator (see §18). Open-source dependencies are governed by their respective licences. Nothing in these Terms grants you any right in our trademarks or brand assets.

If you participate in TestFlight builds, internal beta releases, or any feature we label "beta", "preview", or "experimental", you understand that:

12. Suspension and termination

By you: you may stop using CalTrack and delete your account from Settings → Account → Delete account at any time.

By us: we may suspend or terminate your account if you breach these Terms, abuse the service, or if continued operation would expose us to legal or security risk. Where reasonably possible we will warn you first.

Sections that by their nature should survive termination (§6, §7, §10, §13, §14, §15, §16) will survive.

13. Disclaimer of warranties

To the maximum extent permitted by law, CalTrack is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy of nutrition or expenditure calculations, non-infringement, or that the service will be uninterrupted, error-free, or secure.

Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions these exclusions apply to the maximum extent permitted by law.

14. Limitation of liability

To the maximum extent permitted by law, in no event will the operator be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of CalTrack — even if we have been advised of the possibility of such damages.

Our total cumulative liability arising out of or related to these Terms or your use of CalTrack will not exceed the greater of (a) the amount you paid us for the service in the 12 months preceding the event giving rise to the claim, or (b) USD 50.

Nothing in these Terms limits liability that cannot be limited by law (for example, liability for fraud, death, or personal injury caused by negligence).

15. Indemnification

You agree to indemnify and hold harmless the operator from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of CalTrack, or your violation of any law or the rights of any third party.

16. Governing law and disputes

These Terms are governed by the federal laws of the United Arab Emirates and the laws of the Emirate of Dubai, without regard to conflict-of-laws rules. You and we agree to submit to the exclusive jurisdiction of the on-shore courts of the Emirate of Dubai for any dispute arising out of or relating to these Terms — except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property rights.

If you are a consumer in the European Union, the United Kingdom, or another jurisdiction whose consumer-protection laws guarantee you the protection of local mandatory rules, nothing in this section deprives you of those protections.

17. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will update the "Last updated" date at the top and notify you in-app before the change takes effect. Continued use of CalTrack after the change means you accept the updated Terms.
